    Users outside New Zealand: Our website is operated by us from New Zealand. The information on our website may not be appropriate or available for use in other jurisdictions.     Website Use: The website is provided for our customers to use to find out more about our range of products and services. Products and product information displayed on the website do not represent an offer of sale. Products displayed are not available for purchase in all of our stores. To purchase products from us, we invite you to visit one of our stores or submit an offer through our online ordering facility.

    Registration and accounts: By registering on our website, you consent to receiving marketing, promotional and other material from us. You must ensure that all usernames and passwords required to access our website are kept secure and confidential and you must notify us immediately of any unauthorized use of your password or any other breach of security.     Product Information: We have made every effort to display the products featured as accurately as possible. The equipment you use to view our website may impact on the display of our products. However measurements provided on our website are approximate only. We do not guarantee that the colour, texture or detail of the product shown on your screen will accurately reflect the actual product. You may wish to view our product range in store prior to making your purchase decision. We reserve the right to change any aspect of our product information (including price) at any time without notice.

    Prices: Prices are displayed in New Zealand dollars, exclusive of goods and services tax (GST). We have made every effort to provide accurate pricing information on our website. In the event of a pricing error on our website, to the maximum extent permitted by law, the website price will not be honoured at our stores. Where the pricing error is reasonably obvious we may cancel any orders through our website.
    Pre Order Pricing: Items that are available to pre order during a promotion are not covered under or subject to the promotional offer (unless specifically stated otherwise).

    Stock Availability: Products displayed on our website are subject to availability. We endeavour to provide accurate stock availability information on our website, but stock is not updated in real time. Therefore, even if a product is classified as being “in stock” that stock may not be available to purchase at our stores or online.

    Terms of Sale

    In addition to the above General Website Terms and Conditions, the following terms and conditions of sale apply to all purchases by you through our website. By completing a purchase order you are stating that you agree to be bound by all of these terms and conditions.

    Acceptance of Orders: Dispatch of orders is subject to stock availability and you will be advised if a product is unavailable. To the maximum extent permitted by law, we will not be liable to any person if we decline to fulfil, or are unable to fulfil, an order.

    Prices: We will charge you the retail price shown on the website at the time you submit your order together with any additional handling and delivery fees.

    Payment: You may pay online by charging to your account (but only if you are a Whitcoulls Business Account holder), credit card (NZ$) and by Whitcoulls Gift Card or eGift Card.

    Delivery: We currently deliver only to New Zealand addresses. You must make sure that the delivery address and receiver’s name for your order is accurate and complete (including any business name if you ask us to deliver to a work address) because we may be unable to change these details once the order has been placed. We cannot take responsibility for any orders that go missing due to incorrect delivery information provided by you, or because you have not chosen a safe delivery address. Our delivery information is set out on our Delivery Information page. Delivery will be deemed to have been made when the goods arrive at the delivery point agreed with you, or, if you are to arrange delivery, when the goods are available for collection by you.

    You must notify us within 3 days of the dispatch date (as stated in the email we send confirming dispatch) if you have not received an item. It is your responsibility to take care of the goods when they have been delivered in accordance with the instructions you have given us.

    Returns: Any return of goods is subject to our Returns Policy.

    Our liability to you: If you buy goods or services from us for personal use, the guarantees set out in the Consumer Guarantees Act 1993 will apply to those goods or services.

    If you buy goods or services for business use, then we exclude all warranties, representations or conditions in relation to the goods and/or services provided by us implied by law, trade, custom or otherwise, our liability for any claim, damages, loss or expense related to the supply or use of goods or services is limited to the cost paid by you for those goods or services and we will not be liable, whether in contract, tort (including negligence) or otherwise for any business losses including indirect, consequential or special loss or damage, loss of profits, loss of data, loss of savings and loss of opportunity.

    Whitcoulls Gift Cards & eGift Cards Terms and Conditions
    • You should treat a Gift Card or eGift Card as if it is cash. If it is lost or stolen, it cannot be replaced or cancelled.
    • Gift Cards & eGift Cards have no value until activated at time of purchase.
    • Gift Cards & eGift Cards are issued by Whitcoulls 2011 Limited.
    • Gift Cards & eGift Cards are redeemable for products (excluding Lotto, gift cards or gift vouchers, eGift Cards, or stamps) at Whitcoulls stores and on our websites.
    • A Gift Card or eGift Card may not be returned, redeemed for cash or credited to an account.
    • A Gift card or eGift Card cannot be reloaded, and unused balances at the expiry date will not be refunded.
    • Any unused value on the Gift Card or eGift Card expires 2 years after date of issue.
    • To use, simply present the Gift Card or eGift Card for full or part payment of goods at the time of purchase. The amount of any purchase will be deducted from the Gift Card or eGift Card.
    • Whitcoulls Gift Cards can be purchased in store and on our websites. eGift Cards are only available to purchase on this website - whitcoullsbusiness.co.nz
    • Whitcoulls is not responsible if a Gift Card or eGift Card is lost, altered, damaged or stolen, or used without permission.
    • Gift Cards & eGift Cards will not be refunded or replaced.


    Whitcoulls Business & General Competition Terms and Conditions of Entry

    1. These Conditions of Entry and Competition Rules apply to all Whitcoulls 2011 Ltd. (Whitcoulls, we, us) and Whitcoulls Business competitions. Whitcoulls 2011 Ltd. reserves the right to end any competition or amend the rules at any time.

    2. When you enter into the promotion you accept of these Conditions of Entry and Competition Rules. Whitcoulls reserves the right to exclude any person from the contest on the grounds of criminal record.


    3. This Promotion is only open to “Eligible Entrants”, being individuals who: (i) are residents of New Zealand and (ii) are not employees or agents of the Promoter or any of its related corporations or any agencies associated with the Promotion; and (iii) are not a spouse, de facto partner, parent, child or close family member of an employee or agent; and (iv) are not otherwise professionally connected with the Promotion.

    4. Multiple entries are acceptable (unless otherwise stated) but each must be made as a separate entry, and with a separate proof of purchase (if you must purchase to enter) where applicable. Entrants may not use any automated voting system.

    5. The judge’s decision will be final and no correspondence will be entered into.

    6. If the prize includes travel: Where the winner is under 18 years of age they MUST be accompanied by a parent or guardian aged 18 or over. Proof of age and identity may be required.

    7. If the prize includes international travel: The winner MUST have a valid passport and relevant visas. (For travel to or through United States only). It is the winner’s responsibility when travelling into or through (transiting included) the United States under the Visa Waiver Program to apply for an Electronic System for Travel Authorisation (ESTA) no later than 72 hours prior to departure. The winner must visit the US Department of Homeland Security website and fill in the required information.

    8. Any changes to travel dates or additional accommodation outside the travel period specified made by the winner, which incur additional costs, must be paid for by the prize winner.

    9. All personal Incidental costs, such as but not limited to, passport costs, travel insurance, departure taxes, airport transfers and all other personal expenditures will be at the winner’s expense.

    10. Whitcoulls disclaims any responsibility for the inability to complete or continue an entry due to equipment malfunction, loss of mail, acts of God or otherwise.

    11. Where prizes are provided by a third party, Whitcoulls is not responsible for any loss or damage whatsoever (including but not limited to direct or consequential loss) or for personal injury as a result of the prizes.

    12. By participating and accepting a prize, all winners grant Whitcoulls exclusive permission to use their names, characters, photographs, voices and likeness in connection with promotion of this and other contests, and waive any claims to royalty, right or remuneration for such use.

    13. All personal details provided to participate in these promotions will be held by Whitcoulls for the purpose of this promotion and entries may be used by us for future promotional and marketing purposes, unless otherwise advised by entrants.

    14. Whitcoulls reserves the right to refuse any prize to a person who is reasonably considered to have breached any of the competition terms, or gained unfair advantage in participating in the promotion or obtained a winner status using fraudulent means.

    15. If a purchase is necessary to win, this will be made clear.

    16. If entry to this competition is being made on-line (e.g. via www.whitcoulls.co.nz, by completing an entry), in addition, the participant agrees to be bound by our website general Terms and Conditions of Use. In the event of conflict between these Competition Terms and Conditions and the website Standard Terms and Conditions of Use, the specific Competition Terms and Conditions will prevail.

    17. Whitcoulls reserves the right to discontinue a promotion or competition at any stage.

    18. The Promoter is Whitcoulls 2011 Ltd, Level 2, 29 Union Street, Auckland.

    19. All prizes must be claimed within 60 days of winning.

    20. We will do our best to notify the winners of time remaining – it is the sole responsibility of the winner to claim their prize. All unclaimed prizes will be forfeited.

    21. In the event a winner chooses not to accept a prize, they forfeit any claims to the prize, which can then be awarded to a runner-up at our discretion.

    22. We may dispose of any unclaimed prize at the end of 60 days.

    23. If the specified prize is unavailable due to unforeseen circumstances we may substitute another prize of similar or equal value.

    24. Whitcoulls is not responsible for misuse of a claimed prize or for the performance of goods or services provided by any third party.

    25. The prizes are not redeemable for cash or transferable. Only the person who originally entered the promotion can be awarded the prize. No other family members, friends, office associates or any other person will be able to participate on another person’s behalf.

    26. Unless otherwise stated winners will be picked at random. If there are various methods of entry (e.g.: enter online, in store via entry form or by swiping your Whitcoulls Rewards card) all entries will be collated, and winner(s) picked at random.

    27. Winners will be contacted by phone or email. If we are unable to contact the winner (using contact details provided on the entry form) after trying several times over a 24 hour period, they may pick another winner. The only exception to this is if the prize is time critical, then Whitcoulls will make a reasonable attempt to contact winner before picking another winner.

    28. If competition entry is automatic on swiping your Whitcoulls Rewards card, then the winner’s Rewards account contact details will be used to contact them. It is Whitcoulls Rewards members’ responsibility to ensure their Rewards account details are kept up to date. If we are unable to contact the winner, we will pick another winner.
